Judge Throws Out Dental Practice’s Case Against Insurance Company for Denying COVID-19-Related Claim
Rock Dental Arkansas PLLC and Rock Dental Missouri LLC filed a case against their insurance company, Cincinnati Insurance, in June after it denied Rock Dental’s claims of business losses due to the closure of dental offices, with the exception of emergency treatment, due to the global pandemic. With 49 practices in Arkansas and 16 in Missouri, Rock Dental had applied for compensation through their “all risk” policy, which did not explicitly prohibit expenses related to a pandemic or transmissible diseases from coverage. Once the claim was denied, Rock Dental sued Cincinnati for breach of contract. The judge deliberating the case dismissed it because Rock Dental was unable to prove that their losses were explicitly related to “physical loss or damage” caused by COVID-19. Click here to read more.
