COVID-19 Testing: Must Employers Cover the Cost?

On January 13, the Supreme Court struck down the federal government’s requirement that companies with more than 100 employees either mandate COVID-19 vaccination or weekly testing. However, businesses may still want to test employees as a condition of employment. This leaves some employers wondering whether they need to cover this cost. For businesses located in California, Illinois, Montana, New Hampshire, North Dakota, and South Dakota, the answer is yes because these states require employers to pay for any tests required for employment. For businesses in other states, who bears the financial responsibility remains less clear.
